Abstract:
Along with the oil spill accidents frequent occurrence, the natural fishery resources inevitably suffer large damage while the marine environment was polluted. Grave concerns have been raised over how to correctly, reasonably, and quickly assess the loss of natural resources from oil spills. However, there is a lack of interlinking between judicial appraisal and assessment in judicial practice in these cases. Considering the existing research results, standards, and typical judicial practices, this study proposed a judicial identification work process and assessment method for identifying & assessing natural fishery resources damage caused by marine oil spill accidents. This work aims to promote the standardization of evaluating the damage to natural fishery resources in marine oil spill accidents.
